Terminology used

“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically every handling of data.

“Pseudonymisation” means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

“Profiling” means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

“Processor” (Auftragsverarbeiter) means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal bases

In accordance with Art. 13 GDPR, we inform you of the legal bases of our data processing. Unless the legal basis is stated in this Privacy Policy, the following applies: the legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR; the legal basis for processing in order to perform our services and carry out contractual measures as well as to respond to enquiries is Art. 6(1)(b) GDPR; the legal basis for processing in order to comply with our legal obligations is Art. 6(1)(c) GDPR; and the legal basis for processing in order to safeguard our legitimate interests is Art. 6(1)(f) GDPR. In the event that vital interests of the data subject or of another natural person require the processing of personal data, Art. 6(1)(d) GDPR serves as the legal basis.

Security measures

In accordance with Art. 32 GDPR, and taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.

These measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to, input, disclosure, securing the availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subjects’ rights, the erasure of data and the response to threats to the data. In addition, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).

Cooperation with processors and third parties

Where, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit data to them or otherwise grant them access to the data, this is done only on the basis of a statutory permission (e.g. if the transfer of data to third parties, such as payment service providers, is required for the performance of a contract pursuant to Art. 6(1)(b) GDPR), if you have consented, if a legal obligation provides for this, or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).

Where we commission third parties to process data on the basis of a so-called “data processing agreement” (Auftragsverarbeitungsvertrag), this is done on the basis of Art. 28 GDPR.

Transfers to third countries

Where we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or where this occurs in the context of using third-party services or disclosing or transferring data to third parties, this is done only if it is necessary to fulfil our (pre-)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to statutory or contractual permissions, we process data in a third country, or have it processed there, only if the special requirements of Art. 44 et seq. GDPR are met. This means, for example, that processing takes place on the basis of special guarantees, such as the officially recognised determination of a level of data protection equivalent to that of the EU (e.g. for the USA through the “Privacy Shield”), or compliance with officially recognised special contractual obligations (so-called “standard contractual clauses”).

Rights of data subjects

You have the right to obtain confirmation as to whether data concerning you is being processed, and to access this data as well as to further information and a copy of the data in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you.

In accordance with Art. 17 GDPR, you have the right to request that the data concerned be erased without undue delay or, alternatively, in accordance with Art. 18 GDPR, to request restriction of the processing of the data.

You have the right to receive the data concerning you that you have provided to us in accordance with Art. 20 GDPR and to request its transmission to other controllers.

Pursuant to Art. 77 GDPR, you also have the right to lodge a complaint with the competent supervisory authority.

Right of withdrawal (Widerrufsrecht)

You have the right to withdraw any consent given, with effect for the future, pursuant to Art. 7(3) GDPR

Right to object (Widerspruchsrecht)

You may object at any time to the future processing of data concerning you in accordance with Art. 21 GDPR. In particular, the objection may be made against processing for the purposes of direct marketing.

Cookies and right to object to direct marketing

“Cookies” are small files that are stored on users’ computers. Various pieces of information can be stored within cookies. A cookie serves primarily to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offering. Temporary cookies, or “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie may store, for example, the contents of a shopping cart in an online shop or a login status. Cookies that remain stored even after the browser is closed are referred to as “permanent” or “persistent”. For example, the login status can be saved if users visit the site again after several days. Likewise, such a cookie may store users’ interests, which are used for reach measurement or marketing purposes. “Third-party cookies” are cookies offered by providers other than the controller operating the online offering (otherwise, if they are only the controller’s own cookies, they are referred to as “first-party cookies”).

We may use temporary and permanent cookies and provide information about this in our Privacy Policy.

If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in their browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Excluding cookies may lead to functional limitations of this online offering.

A general objection to the use of cookies employed for online marketing purposes can be declared for a large number of services, especially in the case of tracking, via the US website http://www.aboutads.info/choices/ or the EU website http://www.youronlinechoices.com/. Furthermore, the storage of cookies can be prevented by disabling them in the browser settings. Please note that in this case not all functions of this online offering may be available.

Erasure of data

The data processed by us is erased or its processing is restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this Privacy Policy, the data stored by us is erased as soon as it is no longer required for its intended purpose and the erasure does not conflict with any statutory retention obligations. If the data is not erased because it is required for other, legally permissible purposes, its processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for reasons of commercial or tax law.

Under the statutory requirements in Germany, data is retained in particular for 10 years in accordance with Sections 147(1) of the German Fiscal Code (AO) and 257(1) nos. 1 and 4, (4) of the German Commercial Code (HGB) (books, records, management reports, accounting vouchers, commercial books, documents relevant for taxation, etc.) and for 6 years in accordance with Section 257(1) nos. 2 and 3, (4) HGB (commercial letters).

Under the statutory requirements in Austria, data is retained in particular for 7 years in accordance with Section 132(1) of the Austrian Federal Fiscal Code (BAO) (accounting documents, vouchers/invoices, accounts, receipts, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate, and for 10 years for documents relating to electronically supplied services, telecommunications, radio and television services provided to non-entrepreneurs in EU Member States and for which the Mini-One-Stop-Shop (MOSS) is used.

Agency services

We process our clients’ data within the scope of our contractual services, which include conceptual and strategic consulting, campaign planning, software and design development/consulting or maintenance, implementation of campaigns and processes/handling, server administration, data analysis/consulting services and training services.

In doing so, we process master data (e.g. customer master data such as names or addresses), contact data (e.g. email, telephone numbers), content data (e.g. text entries, photographs, videos), contract data (e.g. subject matter of the contract, term), payment data (e.g. bank details, payment history), usage data and metadata (e.g. in the context of evaluating and measuring the success of marketing measures). As a matter of principle, we do not process special categories of personal data unless they form part of a commissioned processing. The data subjects include our clients, prospective clients as well as their customers, users, website visitors or employees, and third parties. The purpose of the processing is the provision of contractual services, billing and our customer service. The legal bases for the processing arise from Art. 6(1)(b) GDPR (contractual services) and Art. 6(1)(f) GDPR (analysis, statistics, optimisation, security measures). We process data that is necessary to establish and fulfil the contractual services and point out the necessity of providing it. Disclosure to external parties takes place only if it is necessary within the scope of an order. When processing data provided to us within the scope of an order, we act in accordance with the instructions of the clients and the statutory requirements for processing on behalf of a controller pursuant to Art. 28 GDPR, and do not process the data for any purposes other than those specified in the order.

We erase the data after the expiry of statutory warranty and comparable obligations. The necessity of retaining the data is reviewed every three years; in the case of statutory archiving obligations, erasure takes place after their expiry (6 years pursuant to Section 257(1) HGB, 10 years pursuant to Section 147(1) AO). In the case of data disclosed to us by the client within the scope of an order, we erase the data in accordance with the specifications of the order, as a rule after the end of the order.

Contacting us

When contacting us (e.g. via contact form, email, telephone or social media), the user’s details are processed for the purpose of handling the contact request and its processing in accordance with Art. 6(1)(b) GDPR. Users’ details may be stored in a customer relationship management system (“CRM system”) or a comparable enquiry management system.

We erase the enquiries once they are no longer required. We review the necessity every two years; statutory archiving obligations also apply.

Newsletter

With the following information, we inform you about the content of our newsletter as well as the registration, dispatch and statistical evaluation procedures and your rights to object. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Content of the newsletter: We send newsletters, emails and other electronic notifications containing promotional information (hereinafter “newsletter”) only with the consent of the recipients or on the basis of a statutory permission. Where the content of the newsletter is specifically described in the course of registering for it, this description is decisive for the users’ consent. Otherwise, our newsletters contain information about our services and about us.

Double opt-in and logging: Registration for our newsletter takes place using a so-called double opt-in procedure. This means that after registering, you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register using another person’s email address. Newsletter registrations are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored with the dispatch service provider are likewise logged.

Registration data: To register for the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide a name so that we can address you personally in the newsletter.

The dispatch of the newsletter and the associated performance measurement are based on the recipients’ consent pursuant to Art. 6(1)(a), Art. 7 GDPR in conjunction with Section 7(2) no. 3 of the German Act Against Unfair Competition (UWG) or, if consent is not required, on the basis of our legitimate interests in direct marketing pursuant to Art. 6(1)(f) GDPR in conjunction with Section 7(3) UWG.

The registration procedure is logged on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR. Our interest lies in using a user-friendly and secure newsletter system that serves our business interests, meets users’ expectations and also allows us to prove consent.

Cancellation/withdrawal – You may cancel your subscription to our newsletter at any time, i.e. withdraw your consent. You will find a link to cancel the newsletter at the end of each newsletter. We may store unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them, in order to be able to prove previously given consent. The processing of this data is limited to the purpose of a possible defence against claims. An individual erasure request is possible at any time, provided that the former existence of consent is confirmed at the same time.

Newsletter – Mailchimp

The newsletter is sent via the dispatch service provider “MailChimp”, a newsletter dispatch platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the dispatch service provider’s privacy policy here: https://mailchimp.com/legal/privacy/.
The Rocket Science Group LLC d/b/a MailChimp is certified under the Privacy Shield Framework and thereby offers a guarantee of compliance with the European level of data protection (https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active). The dispatch service provider is used on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR and a data processing agreement pursuant to Art. 28(3) sentence 1 GDPR.

The dispatch service provider may use the recipients’ data in pseudonymised form, i.e. without attribution to a user, to optimise or improve its own services, e.g. for the technical optimisation of the dispatch and presentation of the newsletter or for statistical purposes. However, the dispatch service provider does not use the data of our newsletter recipients to contact them itself or to pass the data on to third parties.

Hosting and email dispatch

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, email dispatch, security services and technical maintenance services, which we use for the purpose of operating this online offering.

In doing so, we or our hosting provider process master data, contact data, content data, contract data, usage data, meta and communication data of clients, prospective clients and visitors to this online offering on the basis of our legitimate interests in the efficient and secure provision of this online offering pursuant to Art. 6(1)(f) GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Collection of access data and log files

On the basis of our legitimate interests within the meaning of Art. 6(1)(f) GDPR, we or our hosting provider collect data on every access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.

For security reasons (e.g. to investigate misuse or fraud), log file information is stored for a maximum of 7 days and then deleted. Data whose further retention is required for evidentiary purposes is exempt from erasure until the respective incident has been finally resolved.

Google Tag Manager

Google Tag Manager is a solution with which we can manage so-called website tags via an interface (and thus, for example, integrate Google Analytics and other Google marketing services into our online offering). The Tag Manager itself (which implements the tags) does not process any personal data of users. With regard to the processing of users’ personal data, please refer to the following information on the Google services. Usage policy: https://www.google.com/intl/de/tagmanager/use-policy.html

Google Analytics

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use Google Analytics, a web analytics service of Google LLC (“Google”). Google uses cookies. The information generated by the cookie about users’ use of the online offering is generally transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Framework and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate users’ use of our online offering, to compile reports on activities within this online offering and to provide us with further services associated with the use of this online offering and the internet. Pseudonymous user profiles may be created from the processed data.

We use Google Analytics only with IP anonymisation enabled. This means that users’ IP addresses are truncated by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

The IP address transmitted by the user’s browser is not merged with other Google data. Users can prevent the storage of cookies by adjusting their browser software accordingly; in addition, users can prevent the collection by Google of the data generated by the cookie and relating to their use of the online offering, as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de

Further information on Google’s use of data and on settings and objection options can be found in Google’s privacy policy (https://policies.google.com/technologies/ads) and in the settings for the display of advertisements by Google (https://adssettings.google.com/authenticated).

Users’ personal data is deleted or anonymised after 26 months.

Audience building with Google Analytics

We use Google Analytics to display the advertisements placed within the advertising services of Google and its partners only to users who have shown an interest in our online offering or who exhibit certain characteristics (e.g. interests in certain topics or products, determined on the basis of the websites visited) that we transmit to Google (so-called “remarketing audiences” or “Google Analytics audiences”). With the help of remarketing audiences, we also want to ensure that our advertisements correspond to the potential interests of users.

Google AdWords and conversion measurement

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

Google is certified under the Privacy Shield Framework and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use Google’s online marketing procedure “AdWords” to place advertisements in the Google advertising network (e.g. in search results, in videos, on websites, etc.) so that they are displayed to users who have a presumed interest in the advertisements. This allows us to display advertisements for and within our online offering in a more targeted manner, so as to present users only with advertisements that potentially match their interests. If, for example, a user is shown advertisements for products in which they have shown an interest on other online offerings, this is referred to as “remarketing”. For these purposes, when our website and other websites on which the Google advertising network is active are accessed, Google directly executes a Google code and so-called (re)marketing tags (invisible graphics or code, also referred to as “web beacons”) are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user’s device (comparable technologies may also be used instead of cookies). This file records which websites the user has visited, which content they are interested in and which offers they have clicked on, as well as technical information about the browser and operating system, referring websites, time of visit and further information on the use of the online offering.
